E-Pawn” is a registered business trading name of MotoCafe Holdings Pty Ltd [ABN 69 620 572 223], which holds a Pawnbrokers & Secondhand Dealers Licence (NSW) [2PS26801]. Any mention of “us” or “we” on this website refers to MotoCafe Holdings Pty Ltd, which terms may also be written or expressed as “E-Pawn” and/or “EPawn”. The privacy obligations outlined in the Privacy Act 1988 (Cth) as they apply to MotoCafe Holdings Pty Ltd, also apply to any business conducted in the name E-Pawn.

This privacy policy outlines how we comply with our obligations under the Privacy Act 1988 (Privacy Act). In this policy, ‘personal information’ and ‘information’ are used interchangeably and have the same meaning as defined by section 6 of the Privacy Act.

E-Pawn collects personal information to provide you with the products and services you request and to inform you about other products and services offered by or through us.

E-Pawn is committed to protecting your personal information in accordance with the Australian Privacy Principles (APP) under the Privacy Act (which can be found at: http://www.oaic.gov.au/privacy) together with  applicable industry privacy codes.

Why We Collect Information

Any information you provide to E-Pawn, whether via the internet or by other means, is collected only for purposes that are reasonably necessary for, or directly related to, one or more of E-Pawn’s business functions or activities. These purposes include:

Providing customers with the products and services they request and monitoring, evaluating, and delivering those products and services; Assisting customers with queries, resolving customer complaints, or requests for access to information, or managing any legal action involving E-Pawn; Managing customer relationships or accounts and performing other administrative and operational tasks (including risk management, systems development and testing, staff training, debt collection, and market or customer satisfaction research); Providing information on products and services offered by E-Pawn, affiliated product and service providers, and external product and service providers for whom we act as agent (unless the customer has opted out); Complying with our legal obligations under the ‘Pawnbrokers and Second-Hand Dealers Act 1996‘ (NSW) and acts such as the ‘Privacy Act’ and the ‘Anti-Money Laundering and Counter-Terrorism Financing Act 2006‘, as well as any other relevant legislation governing pawnbroking in NSW; Identifying customers or establishing their tax status under any Australian or foreign legislation, regulation, or treaty, or pursuant to an agreement with any tax authority; Gathering and aggregating information for statistical, prudential, actuarial, and research purposes; Developing and implementing measures to detect or prevent fraud and credit loss.

In addition, as required by Part IIIA of the Privacy Act, we may obtain your consent to collect, use, and disclose information about you.

If you choose not to provide information that we require for the above purposes, we may be unable to provide you with the goods and services you request from us.

What We Collect

Personal information collected by E-Pawn (or on our behalf) generally includes name, address, date of birth, gender, marital status, occupation, account details, contact details (including telephone, facsimile, and email), and financial information. Occasionally, we may collect additional personal details to help identify you over the phone.

If you are applying for credit, we may also collect the number and ages of your dependents, the length of time at your current address, your employer’s name and contact details, the length of your employment, proof of earnings, and, if you have recently changed employers, details of your previous employment.

Disclosure

E-Pawn will not disclose your information to Government agencies, private sector organizations, or anyone else unless one of the following applies:

You have consented; You would reasonably expect, or have been informed, that information of that kind is usually passed to those individuals, bodies, or agencies; It is otherwise required or authorized by law; By your actions, we consider you to have released us from our duty of confidentiality or to have consented to the disclosure of information about you without explicitly stating so (for example, if you discuss your financial position publicly with the media); It will prevent or lessen a serious and imminent threat to somebody’s life or health; or It is reasonably necessary for the enforcement of the criminal law, a law imposing a pecuniary penalty, or for the protection of public revenue.

Depending on the product or service E-Pawn has provided you with, we may disclose information to:

Affiliated product and service providers and external product and service providers for whom we act as agent (so they may provide you with the product or service you seek or in which you have expressed an interest); Auditors we appoint to ensure the integrity of our operations; Any person acting on your behalf, including your financial adviser, solicitor, settlement agent, accountant, executor, administrator, trustee, guardian, or attorney; Your employer(s), referee(s), guarantor(s), or potential guarantor(s); If required or authorized to do so, regulatory bodies, government agencies, courts, or anyone authorized by any of them to receive such information; Participants in the payments system (including payment organizations and merchants) and other financial institutions (such as banks); Insurers; Any joint borrower(s) or account holder(s); Other financial institutions and organisations at their request if you seek credit from them; Other parties where you have consented to the disclosure; Suppliers from whom we order goods or services on your behalf (so that the goods or services may be provided to you); or Other organizations or individuals specified elsewhere in this policy.

Identity Verification

E-Pawn is required by law to conduct identity verification checks under legislation such as the ‘Pawnbrokers and Second-Hand Dealers Act 1996‘ (NSW)

If you fail to provide the necessary personal information to establish your identity, we may not be able to offer you our products or services. This may include identifying you under agreements or arrangements with third parties, including banks, credit reporting agencies, or other financial institutions.

Data Storage Overseas

E-Pawn may use cloud-based technologies and third-party providers located in countries other than Australia for purposes such as business continuity and software delivery. In addition, some third-party providers we use to help us operate our website may be located in countries outside Australia.

As a result, your information may be stored or accessed by organizations located outside Australia. However, this does not diminish the level of protection we provide for your personal information.

When we transfer personal information overseas, we ensure that the information is transferred and stored in accordance with the law and our obligations under the Privacy Act, including APP 8.

Security

We use multiple layers of security to ensure the confidentiality of the personal information we hold. Tools such as firewalls and encryption help ensure your information is secure and safeguarded from unauthorized access, modification, or disclosure. Additionally, we train our employees on privacy and security issues and restrict access to personal information to employees who need it to perform their jobs.

If we hold personal information about you, it is securely stored in electronic or physical form. Our policy is to retain personal information no longer than is required to fulfill the purpose for which it was collected or as required by law. If we determine that the information is no longer needed, we will take reasonable steps to de-identify or securely destroy it.

Complaints

If you believe E-Pawn has breached its privacy obligations, your complaint may be directed to any E-Pawn Branch, using the phone number or email address in our Contact section. We will promptly review your complaint and attempt to resolve any issue to your satisfaction. We may ask you to submit your complaint in writing.

E-Pawn aims to resolve any complaint to the complainant’s satisfaction and has an established procedure for handling privacy complaints. Our Privacy Officer will investigate the complaint and respond to you in writing within 30 days of receiving your complaint. If the complaint is not resolved to your satisfaction, you can refer the matter to the Australian Information Commissioner.

Amendments to this Privacy Policy

We may make changes to this policy from time to time. If we do, we will place an updated version of this policy on our website. Any changes will apply to all information collected on or after the update date. The updated policy will be dated, and your continued use of our products or services after any changes have been made constitutes your acceptance of the changes.

FAQs

Will E-Pawn share my private information?

No. E-Pawn will not share your personal information with anyone, nor will we use it for any purpose other than directly in relation to your pawn loan with us. However, there may be occasions where we are legally compelled by a court order to produce your personal information.
